Francis R. Kirkham Law Clerk papers, circa 1935-1938 (inclusive)

Abstract:
Francis Kirkham (1904-1996) was born in Utah in 1904. After earning his undergraduate and law degrees from George Washington University, Kirkham clerked for two Supreme Court Justices, including former Chief Justice Evan Hughes. During his time as a law clerk, Kirkham drafted a report suggesting revisions to the way people filed for bankruptcy, which was a pertinent issue in the wake of the Great Depression. This report, "Suggested Revisions to the General Orders and Forms of Bankruptcy," was published in 1939. The collection, circa 1935-1939, includes correspondence with Supreme Court Justices, drafts, reports, National Bankruptcy Conference drafts, and related material regarding Kirkham's activity as a Supreme Court law clerk drafting the "General Order and Rules of Bankruptcy," which was published in 1939.

Collection of "Recent Bankruptcy Decisions" by George Treister, 1981-1990, 1992-1998 (inclusive)

Abstract:
George Treister (b. 1923) was a founding partner of Stutman, Treister, and Glatt. A graduate of Yale University Law School in 1949, Treister was a member of the Judicial Conference's Advisory Committee on Bankruptcy Rules and the National Bankruptcy Conference, where he served as Vice Chairman from 1971 to 1984. He is the author of a number of bankruptcy volumes, including "Recent Bankruptcy Decisions," a compendium of judicial decisions regarding bankruptcy legislation, used as educational material by nearly all major bankruptcy seminars. The collection comprises volumes of George Treister's "Recent Bankruptcy Decisions" from 1981 to 1990 and from 1992 to 1998.

Abstract:
Randall J. Newsome (b. 1950) graduated from the University of Cincinnati Law School in 1975. In 1998, Newsome was appointed to the Northern District of California's bankruptcy court, where he became Chief Judge in 2004. Randall Newsome has served as a faculty member for the Federal Judicial Center since 1987. He joined the National Conference of Bankruptcy Judges in 1983, serving as President from 1998-1999. He is a fellow of the American College of Bankruptcy. The collection (1993-2004) contains audio cassette tapes of interviews conducted by Newsome with figures in bankruptcy law, including judges, attorneys, and educators.

Richard Levin was a New York based bankruptcy lawyer who served as assistant counsel to the House Judiciary Committee between 1975 and 1978. He dedicated those years to the penning of US Federal Bankruptcy Code. Richard Levin Documents on the Creation of the 1978 United States Bankruptcy Code is composed of a collection of research reports, drafts, correspondence, and other documents that describe the creation and follow the progress of the 1978 US Bankruptcy Code largely during the years 1967-1978 with supplementary information from years 1933, 1934, 1959, 1960, 1966, and Bankruptcy Statistics Tables dated 1960-1969.

Abstract:
The National Bankruptcy Conference is a voluntary, non-profit, self-supporting organization of lawyers, law teachers, and bankruptcy judges who have achieved scholarly distinction in the field of bankruptcy law. Its purpose is to study the operation of bankruptcy and related laws and proposals for their reform. The Conference participated as a consultant to Congress in every substantial amendment of the Bankruptcy Act up to the 1970s. The collection includes minutes summaries of proceedings of National Bankruptcy Conference meetings from 1948 to 1996 and reports submitted by the Committee on Coordination of Uniform Commercial Code and Bankruptcy Act.

As a teacher, scholar, lawyer, and consultant, Lawrence P. King (1929-2001) played a role in reforming bankruptcy law from the 1960s to his death in 2001. King taught commercial and bankruptcy law at New York University Law School. He served on a number of congressional commissions formed to analyze and reform bankruptcy law, including the Advisory Committee on Bankruptcy Rules of the Judicial Conference of the United States. He gave speeches and participated in panels regarding bankruptcy legislation for a number of seminars and educational programs. He was an active member of the National Bankruptcy Conference, an organization of lawyers, judges, and professors dedicated to bankruptcy reform. Murray Drabkin (1928-) was a commercial bankruptcy lawyer at Hopkins and Sutter in Washington, D.C. until 2001. He was a member of the National Bankruptcy Conference and co-authored the "Judges' bill," which, together with the "Commission bill," drafted by a federal commission to study bankruptcy laws, was the basis for the Bankruptcy Reform Act of 1978. The collection, 1932-1999, includes materials relating to bankruptcy reform and the jurisdiction of bankruptcy judges in the 1970s and 1980s; records and papers of the National Bankruptcy Conference, where Drabkin was an active member; material relating to two legislative projects formed by the National Bankruptcy Conference, the Code Review Project and the Insurance Insolvency Project; correspondence related to the activities of bankruptcy committees in New York and Washington, D.C.; and published manuals, reports, and reference books.

Abstract:
The Judge Joe Lee papers, 1961-2012, consist of material from Lee's active involvement in bankruptcy organizations and legislation. Joe Lee received his law degree from the University of Kentucky in 1955. He served as counsel to the Congressional Labor Subcommittee for the U.S. House of Representatives before being appointed a U.S. Bankruptcy Judge on September 1, 1961. He was one of the longest serving bankruptcy judges in the nation and played a pivotal role in the enactment of the Bankruptcy Reform Act of 1978. The collection includes correspondence, minutes, and reports from the National Conference of Bankruptcy Judges, drafts of bills and correspondence regarding bankruptcy legislation, and Lee's writings on the history of bankruptcy law.

Abstract:
Henry J. Sommer is one of the leading figures in bankruptcy and consumer law. Born in 1949 in Rochester, New York, Sommer received his JD cum laude from Harvard Law School in 1974. After graduating from Harvard, he worked for Community Legal Services in Philadelphia as Project Head of its Consumer Law Project until 1996. In addition to his role with Community Legal Services, Sommer has served on bankruptcy rules committees and worked as editor-in-chief of Collier on Bankruptcy. The Henry J. Sommer Papers, 1966-2014, include National Bankruptcy Conference papers, materials from Continuing Legal Education seminars and other meetings at which Sommer lectured, copies of published manuscripts written by Sommer, and other material related to Sommer's work with consumer law and legal reform.

Judge Arthur N. Votolato was the first bankruptcy judge to sit in Rhode Island, and for 44 years, he was the only U.S. bankruptcy judge to serve the state. He served on the First Circuit Bankruptcy Appellate Panel, Massachusetts and Maine panels. He was Chief Judge, Massachusetts' B.A.P. from 1981 to 1984. The Judge Arthur N. Votolato papers is a small collection of material relating to Votolato's work in bankruptcy law. The collection contains Bankruptcy Appellate Panel materials including correspondence, notes, and outlines, as well as case files, reports, publications including The Conference Newsletter, The Silver Whistle, and other related documents.

Kenneth N. Klee spent his career analyzing bankruptcy law and advocating for pro-debtor reforms to the Bankruptcy Code. He graduated from Harvard Law School in 1974 and joined to the California bar in 1975. He began his career as Associate Counsel for the Subcommittee on Civil and Constitutional Rights, a subunit of the House of Representatives' Committee on the Judiciary, where he advised Congress and helped draft legislation related to bankruptcy reform in the 1970s. He was also a consultant to the House Judiciary Committee from 1977 to 1982 and the Department of Justice from 1983 to 1985. Klee was a member of the National Bankruptcy Conference, an association of scholars and practitioners committed to the study of bankruptcy legislation and reform, where he was chair of the Committee on Legislation from 1992 to 1999. Edward Weinfeld (1901-1988) graduated from the New York University School of Law in 1921. Joseph L. Cosetti was appointed United States Bankruptcy Judge for the Western District of Pennsylvania in 1980, where he served as Chief Judge until 1994. Robert B. Morton (1912-2005) earned his law degree from the University of Kansas in 1935. In 1962, Morton became a judge in the United States Bankruptcy Court, a position he held until 1986. Upon his retirement from the court, Morton worked for Morris, Laing, Evans, Brock and Kennedy, a law firm located in Wichita, Kan. Morton was an active member in a number of bankruptcy and legal organizations, most notably the National Conference of Bankruptcy Judges, where he served as President from 1975 to 1976 and as Treasurer from 1980 to 1982. William J. Weller joined the Administrative Office of the United States Courts as Legislative Affairs Officer in 1976. In 1984 he was at the center of a lawsuit regarding his firing of United States Bankruptcy Judges over a dispute regarding their contract and status of employment. The lawsuit and pending legislation related to a broader dispute over the status of presidentially-appointed bankruptcy judges. Weller left the Administration Office in 1987. Daniel Glosband is the International Bar Association's official liaison of the Creditors Rights and Insolvency Committee to the United Nations Commission on International Trade Law (UNCITRAL) and was one of the primary draftsmen of the UNCITRAL Model Law on Cross-Border Insolvency. Since its establishment in 1966, UNCITRAL has been recognized as the core legal body of the United Nations system in the field of international trade law. The Moore Papers document Judge Thomas Moore's process co-writing Chapter 12 of Title 11 of the United States Bankruptcy Code. This collection contains research on family farm bankruptcies, historical material, competing legislation, legal analyses, speeches and testimonies. The papers are collected from 1979 to 1990 and contain many drafts of the Chapter 12 family farmer legislation adopted by Congress in 1987. Johns-Manville Reorganization Case Court records, 1982-1990 (inclusive)

Abstract:
Johns-Manville was an American corporation that made insulation and roofing materials. In the 1980s, the company faced a number of class-action lawsuits based on asbestos-related injuries from its asbestos insulation. As a result, in 1982 Johns-Manville file for Chapter 11 bankruptcy protection. At the time, the company was the largest to ever file for Chapter 11, also known as corporate known as corporate reorganization. The bankruptcy court of the Southern District of New York heard the case, rendering its decision in 1990. The collection, 1982-1990, includes pleadings and other records filed over the course of the case.

Mark B. McFeeley has well over thirty-five years of experience practicing law in America, of which twenty-eight years (1981-2009) was dedicated to serving as a bankruptcy judge for the U.S. Bankruptcy Court for the District of New Mexico. Judge McFeeley was instrumental in forming the Bankruptcy Appellate Panel for the Tenth Circuit. As a bankruptcy judge, McFeeley was intimately involved with the Bankruptcy Crisis of the 1980s that called into question the constitutionality of the bankruptcy system and the appointment of bankruptcy judges after the Marathon Pipeline decision in June of 1982. In 1984, Judge McFeeley was one of four bankruptcy judges who filed suit against the Administrative Office of the United States Courts. William Foley, the Administrative Office's director, had refused to pay bankruptcy judges, arguing that parts of the Bankruptcy Amendments and Federal Judge Act of 1984 were unconstitutional. This collection of papers contains documents from Judge A. Thomas Small's office between the years 1982 and 2009. Documents include correspondence, handwritten notes, research material, testimonies and drafted legislation. Small actively participated in the legislative process, and much of the collecion covers legislative issues such as the Marathon decision, the creation of Chapter 12 bankruptcy, the creation of Bankruptcy Appellate Panels, and the debate over Bankruptcy Administrators vs. Bankruptcy Trustees. Also included are papers documenting the long range planning process of the United States Judicial Conference and the National Conference of Bankruptcy Judges.

Norman H. Nachman (1909-2001) worked as a Chicago bankruptcy attorney for 60 years, served as President of the Chicago Bar Association, and helped to draft new bankruptcy code. His colleagues named him the "Dean of U.S. Bankruptcy Lawyers." This collection, dated 1983-1998, consists of materials relating to Nachman's career in bankruptcy law and includes case documents, reports on aspects of bankruptcy law, Nachman's daily appointment calendars, business correspondence dated 1992-1998, and various publications including law journals and books authored by his colleagues.

Mary Davies Scott (born in 1944) earned her J.D. from the University of Arkansas, Little Rock, in 1978. Scott was appointed Bankruptcy Judge to the Eastern District of the United States Federal Court in 1987, where she remained until her retirement in 2002. From 1996 to 2002, she served as a member of the Bankruptcy Appellate Panel of the Eighth Circuit Court of Appeals. Scott is a member of the National Conference of Bankruptcy Judges, where she has served in a number of leadership roles. She has served on the Board of Directors of the American College of Bankruptcy since 2002. Scott planned and taught at various workshops and seminars for the Federal Judicial Center, an organization that provides continuing education to the federal judiciary, including bankruptcy judges. This collection includes his personal materials ranging from 1984-2006, consisting mainly of materials concerning the National Conference of Bankruptcy judges, in which Judge Adams was heavily involved, on its Board of Governors from 1996-1999, its secretary in 2000, and its president in 2004. Abstract:
George C. Paine II was born on October 31, 1945 in Nashville, Tenn. He graduated from the University of Mississippi School of Law in 1973. In 1981, Paine was appointed a bankruptcy judge for the Middle District of Tennessee. He has served as Chief Bankruptcy Judge of that district since 1986. In 1984, George Paine was one of four judges who filed suit against the Administrative Office of the United States Courts ("Administrative Office"). The Administrative Office's director, William Foley, had refused to pay bankruptcy judges, arguing that parts of the Bankruptcy Amendments and Federal Judge Act of 1984 were unconstitutional. The case was later rendered moot when Foley rescinded his order and agreed to pay the judges. However, when Foley issued his first memorandum, a number of defendants in bankruptcy cases filed motions to overturn the bankruptcy courts' rulings, citing Foley's assertion that the judges had not been lawfully appointed at the time of the court proceedings. Kronish, Lieb, Weiner, and Hellman LLP Bankruptcy Judges Lawsuit files, 1984-1994 (inclusive)

Abstract:
On July 11, 1984, William Foley, Legislative Affairs Officer of the Administrative Office of the United States Courts ("Administrative Office"), issued a memorandum stating that the Administrative Office would not pay bankruptcy judges because, in its opinion, Congress had acted unlawfully by awarding retroactive terms of office to the normally presidentially-appointed bankruptcy judges. In response, on July 13, 1984, four bankruptcy judges sued Foley and the Administrative Office for abuse of power. The case became commonly known as Lundin v. Foley. The law firm of Kronish, Lieb, Shainswit, Weiner and Hellman (later, Kronish, Lieb, Weiner and Hellman) represented the bankruptcy judges. Richard Lieb served as the primary attorney on the case. This collection contains a brief look into the life and career of Ahron Jay Cristol, the chief judge of the Florida bankruptcy court, a lecturer in law of naval warfare, and a former US Navy aviator and lawyer in the Judge Advocate General's Corps. The collection contains series of Cristol's work as a legal scholar and bankruptcy judge, including testimony given before the US House of Representatives, various speeches given at events and lectures, and a small series of legal opinions written by Cristol, including some written in poetic verse. Frank W. Koger, 1930-2003, received his J.D. from Kansas City University in 1953 and his L.L.M. from University of Missouri in 1966. After having worked in private practice since 1956, Koger was appointed Bankruptcy Judge to the Eighth Judicial Circuit in 1986. He remained in this position until his retirement in 1997. Koger was a member of the American Bar Association, the Commercial Law League of America, and the Missouri Bar Association. He was also a member of the National Conference of Bankruptcy Judges, where he served as Secretary, Vice President, and President in the 1990s. The collection, 1990-1997, chiefly includes records created and assembled by Koger as a member of the National Conference of Bankruptcy Judges from 1993-1997. Judge Bihary received her Juris Doctorate from the University of Michigan Law School in 1975. From 1987-2003, she served as a judge for the U.S. Bankruptcy Court in the Northern District of Georgia. In 2003, Judge Bihary was sworn in as Chief Judge of the U.S. Bankruptcy Court in the Northern District of Georgia. She served this position from 2003 until her retirement in May of 2012. The Judge Joyce Bihary Papers, 1999-2009, includes materials created, collected, and received by Judge Bihary from two periods of her career. First, materials from the 1999 Debtor Education Program in Atlanta, Georgia which contains information regarding American bankruptcy in the mid to late 1990's. Enron Corporation was an American energy, commodities, and services company based in Houston, Texas. Enron began as a pipeline company in Houston in 1985, and later, under the direction of former Chairman Kenneth L. Lay, Enron expanded into an energy broker, trading electricity and other commodities. Enron filed for bankruptcy protection in the Southern District of New York during late 2001 and selected Weil, Gotshal & Manges as its bankruptcy counsel. The collection is largely comprised of the interim reports of Neal Batson, the Court Appointed Examiner.

The Oral History Project was begun by the National Conference of Bankruptcy Judges (NCBJ) at its 2004 Annual Meeting. The purpose of the project was to record interviews in which past presidents of the NCBJ reminisced about the organization and the role they played in it. The project later expanded to encompass oral histories of bankruptcy judges. The collection chiefly includes oral histories recorded with past presidents of the National Conference of Bankruptcy Judges. Accruals to this project include members of the NCBJ who may or may not be former presidents.

Conrad B. Duberstein collection, 2005 (inclusive)

Abstract:
Conrad B. Duberstein (1915-2005) earned his undergraduate degree from Brooklyn College in 1938 and his J.D. from St. John's University Law School in 1942. From 1943 to 1945, Duberstein served in the United States Army. When he left the Army following the end of World War II, Duberstein joined the Brooklyn law firm of Schwartz, Rudin, and Duberstein (the latter partner named after his uncle). In 1971, he became a partner at Otterbourg, Steindler, Houston, and Rosen, where he remained until his retirement in 1981. In 1981, he was appointed to the Eastern District Bankruptcy Court of New York. He was appointed that court's Chief Judge in 1984, a position he held for the rest of his career. In 1991, he was awarded an honorary doctorate from St. John's University Law School. The collection, 2005, contains 5 DVDs of footage honoring the career of Duberstein.
