Overview and metadata sections

Daniel Glosband serves as counsel with Goodwin Procter's Financial Institutions Group and is a member of its Financial Restructuring Practice. Glosband's primary areas of focus are domestic and cross-border insolvency and reorganization. He represents debtors, officers and directors, fiduciaries and counterparties in all manner of sophisticated insolvency situations; advises on the insolvency implications of structuring business transactions; and, as one of the primary draftsmen of Chapter 15 of the Bankruptcy Code (the U.S. cross-border bankruptcy law), represents parties in Chapter 15 cases and provides expert testimony to foreign courts.

Glosband has served on the panel appointed by the First Circuit Court of Appeals to select bankruptcy judges and as a special assistant attorney general for the Commonwealth of Massachusetts, as well as was elected to the initial class of the American College of Bankruptcy, where he served as vice president and a member of the board of directors. He is also a conferee of the National Bankruptcy Conference, which advises Congress on bankruptcy legislation. Additionally, Glosband has acted as an adviser to the U.S. State Department and the American Law Institute on international insolvency projects.

Glosband received his J.D. from Cornell University in 1969, and his B.A. from the University of Massachusetts in 1966. He is a member of the Massachusetts and New York Bars and is admitted to practice before the U.S. District Courts in Massachusetts, Connecticut, Vermont and the Southern District of New York, the U.S. Court of Appeals for the First Circuit and the U.S. Supreme Court.

Glosband is the International Bar Association's official liaison of the Creditors Rights and Insolvency Committee to the United Nations Commission on International Trade Law (UNCITRAL). In this position, he has participated in UNCITRAL projects, including Cross-Border Insolvency and Insolvency Working Groups. Glosband was also one of the primary draftsmen of the UNCITRAL Model Law on Cross-Border Insolvency.

The United Nations Commission on International Trade Law (UNCITRAL) was created to recognize disparities in trade laws across country borders that made international trade difficult, as well as to create laws promoting international trade to be adopted by United Nations member countries. Since its establishment in 1966, UNCITRAL has been recognized as the core legal body of the United Nations system in the field of international trade law. A legal body with universal membership specializing in commercial law reform worldwide for over 40 years, UNCITRAL's objective is to modernize and harmonize the rules of international business.

The Daniel Glosband papers of the United Nations Commission (UNCITRAL) on International Trade Law covers the creation of various international trade and bankruptcy laws, including the UNCITRAL model law on cross-border insolvency formed by UNCITRAL during the years of 1994-2005. The materials come from Daniel Glosband's professional files and relate his participation in UNCITRAL and general involvement in international insolvency law. This collection is divided into nine series: Correspondence; Code References; Drafts; National Bankruptcy Review Commission; News Articles; Notes; Reports; Travel Documents; UNCITRAL Participants; Miscellaneous Media. Materials are dated 1888, 1937-1938, 1978-2005 and undated.

The Correspondence series includes letters, faxes, and emails exchanged among the participants in UNCITRAL and various insolvency law experts.

The Code References series includes copies, some with annotations, of code from the United States, Canada, and Switzerland, that were used as references in the formation of United States bankruptcy reform law and the drafting of UNCITRAL model laws. The series is divided into four subseries: Bankruptcy Reform Act of 1998, Court Opinions, International Bankruptcy Code, and Miscellaneous United States Code. The Bankruptcy Reform Act of 1998 contains copies, some annotated, of the law as it passed through the United States Senate and House of Representatives. Court Opinions are copies of published opinions from United States courts related to bankruptcy cases. International Bankruptcy Code includes copies of Swiss and Canadian legislation from 1995 and 1996. Miscellaneous United States Code includes copies of various United States laws related to bankruptcy.

The Drafts series includes working copies of UNCITRAL documents. These include annotated drafts of Working Group on Insolvency Law of committee reports, memoranda, working papers, and other materials contributing to the creation of the Model Law on Cross-Border Insolvency, 1995-1998, 2000-2004, as well as drafts modifying United States Title 11 Bankruptcy Code to conform to the UNCITRAL Model Law on Cross-Border Insolvency.

The National Bankruptcy Review Commission Documents series contains information about meetings and working groups of the National Bankruptcy Review Commission, 1996-1997.

The News Articles series includes an article from the Harvard Law Review dated January 15, 1888 titled "Conflict of Laws as Applied to Assignments for Creditors" and documents concerning that article. Also included are various bankruptcy news articles dated 1994-1998 and 2000-2001 from newspapers and newsletters.

The Notes series contains Daniel Glosband's handwritten notes on the progress of drafting the UNCITRAL Model Law on Cross-Border Insolvency.

The Reports series includes reports from the United Nations, UNCITRAL Working Groups and other international insolvency related reports.

The Travel Documents series contains flight and general destination information related to Daniel Glosband's travel for UNCITRAL meetings.

The UNCITRAL Participants series contains lists and business cards from people involved in UNCITRAL and the creation of the Model Law on Cross-Border Insolvency.

The Miscellaneous Media series includes two unidentified computer disks.

Each series and subseries is organized chronologically. Materials in this collection are dated: 1888, 1937-1938, 1978-2005 and undated.
