Henry J. Sommer is one of the leading figures in bankruptcy and consumer law. Born in 1949 in Rochester, New York, Sommer received his JD cum laude from Harvard Law School in 1974. After graduating from Harvard, he worked for Community Legal Services in Philadelphia as Project Head of its Consumer Law Project until 1996.
In addition to his role with Community Legal Services, Sommer has played an active role among bankruptcy committees and organizations. He was the President of the National Association of Consumer Bankruptcy Attorneys from 2005 to 2008, a member of the Federal Judicial Conference Advisory Committee on Bankruptcy Rules from 1991 to 1998, a member of the National Bankruptcy Conference since 1983, a member of the Federal Reserve Board Consumer Advisory Council from 1983 to 1985, and a chairman of the Eastern District of Pennsylvania Bankruptcy Conference from 1998 to 1999. Sommer also served as Supervising Attorney for the pro-bono Consumer Bankruptcy Assistance Project in Philadelphia, PA from 1996 to 2018.
Sommer has spoken before both the House and Senate Judiciary Committees and the National Bankruptcy Review Commission. He has lectured at the University of Pennsylvania Law School and has served as faculty on continuing legal education programs with many institutions including the Federal Judicial Center, New York University Law School, National Conference of Bankruptcy Judges, Southeastern Bankruptcy Law Institute, Executive Office of US Trustees, and the Pennsylvania Bar Institute. In 1990, Sommer became the first recipient of National Consumer Law Center's Vern Countryman Consumer Law Award. He also received the Excellence in Education Award from the National Conference of Bankruptcy Judges in 2010.
Sommer has worked as editor-in-chief of Collier on Bankruptcy. Among Sommer's many publications include Collier Consumer Bankruptcy Practice Guide; Consumer Bankruptcy Law and Practice; Consumer Bankruptcy: The Complete Guide to Chapter 7 and Chapter 13 Personal Bankruptcy, in addition to many articles on bankruptcy law. He co-authored Collier Family Law and the Bankruptcy Code, and was a contributing author to the Matthew Bender treatise on Debtor-Creditor Law. At present, Sommer serves as co-Editor-in-Chief for Collier on Bankruptcy.
The Henry J. Sommer papers document Sommer's professional activities, involvement in legislative reform, and writings on bankruptcy law.
Series I: Legislative Activities, 1969-2002, contains correspondence, bill drafts, and research materials on reforming bankruptcy law in the United States. The series contains task force and committee proposals, such as materials from the National Bankruptcy Review Commission and the Insolvency Act Task Force. Also included are resources on consumer credit laws, copies of testimonies before congress, and news clippings.
Series II: National Bankruptcy Conference, 1980-2001, contains reports, correspondence, subcommittee files, and meeting materials from the National Bankruptcy Conference. The "meeting" folders include minutes, dockets, agendas, and correspondence.
Series III. Bankruptcy Rules Committees, 1982-2002, contains meeting minutes, proposals, and correspondence from the Eastern District Local Rules Committee. Also included are materials created by the Federal Judicial Conference Advisory Committee on Bankruptcy Rules which Sommer served on from 1991 to 1998. These folders contain proposed amendments, reviews of bankruptcy forms, and subcommittee reports.
Series IV. Community Legal Services, 1966-2012, contains correspondence, training materials, and litigation files from Sommer's time working at CLS in Philadelphia.
Subseries 1: Correspondence and subject files, 1966-1996, contains correspondence and subject files created by Sommer. The correspondence mostly consists of interoffice memos related to the Consumer Law Project and updates on legislative advocacy.
Subseries 2: Community Reinvestment Act Challenges, 1978-1998, documents CLS's representation of several community groups including Kensington Joint Action Council, Neighborhood Economic Survival Coalition, and the Eastern Philadelphia Organizing Project in challenging banks for violating the Community Reinvestment Act of 1977.
Subseries 3: Litigation, 1971-2012, contains court materials and research from cases that Sommer worked on, including class actions.
Series V. Federal Reserve Board Consumer Advisory Council, 1976-1987, contains correspondence, meeting minutes, and research materials from Sommer's time as a council member from 1983 to 1985. Included are procedures for processing challenges to banks under the Community Reinvestment Act and studies on credit insurance.
Series VI. Meetings and Continuing Legal Education, 1978-2014, contains speaking notes from trainings that Sommer participated in, continuing legal education study materials, and programs from bankruptcy seminars. There are five videotapes from a seminar on the Bankruptcy Reform Act of 1978 that includes a talk given by Sommer. Also included are annual convention booklets from the National Association of Consumer Bankruptcy Attorneys, programs from meetings of the National Conference of Bankruptcy Judges, and notes from consumer rights conferences held by the National Consumer Law Conference.
Series VII. Publications, 1978-2005, consists of early drafts and final publications of books, articles, and textbooks written by Sommer as well as articles written by others on bankruptcy law that Sommer collected.
