Daniel Glosband was one of the primary draftsmen of Chapter 15 of the Bankruptcy Code, which was enacted as part of The Bankruptcy Abuse Prevention and Consumer Protection Act (BAPCPA) in 2005. Drafting began in as early as 1997. Enacted on April 20, 2005, BAPCPA was a significant legislative act that made tremendous changes to personal finance as passed by the United States Congress. It altered American bankruptcy laws, and affected both consumer and business bankruptcies.
Daniel Glosband serves as counsel with Goodwin Procter's Financial Institutions Group and is a member of its Financial Restructuring Practice. Glosband's primary areas of focus are domestic and cross-border insolvency and reorganization. He represents debtors, officers and directors, fiduciaries and counterparties in all manner of sophisticated insolvency situations; advises on the insolvency implications of structuring business transactions; and, as one of the primary draftsmen of Chapter 15 of the Bankruptcy Code (the U.S. cross-border bankruptcy law), represents parties in Chapter 15 cases and provides expert testimony to foreign courts.
Glosband has served on the panel appointed by the First Circuit Court of Appeals to select bankruptcy judges and as a special assistant attorney general for the Commonwealth of Massachusetts, as well as was elected to the initial class of the American College of Bankruptcy, where he served as vice president and a member of the board of directors. He is also a conferee of the National Bankruptcy Conference, which advises Congress on bankruptcy legislation. Additionally, Glosband has acted as an adviser to the U.S. State Department and the American Law Institute on international insolvency projects.
Glosband received his J.D. from Cornell University in 1969, and his B.A. from the University of Massachusetts in 1966. He is a member of the Massachusetts and New York Bars and is admitted to practice before the U.S. District Courts in Massachusetts, Connecticut, Vermont and the Southern District of New York, the U.S. Court of Appeals for the First Circuit and the U.S. Supreme Court.
The Daniel Glosband Papers: 2005 Bankruptcy Reform, is a small collection comprised of five series: Administrative Records; Drafts, 2000; Drafts, 1999; United States Advisory Group; and Chapter 15 Rules. The first series, Administrative Records, include communication and correspondence, press, publications, draft revisions, and other related material. The second and third series', which hold Draft records from 1999 and 2000, include proposed drafting changes, amendments, and communications.
