Abstract:

The "Principles of the Law of Family Dissolution: Analysis and Recommendations" was the American Law Institute's first comprehensive work in the field of family law. The project as a whole comprises six principal parts: Child Custody; Child Support; Division of Property at Dissolution; Compensatory Payments (formerly known as alimony); Domestic Partners; and Agreements. The collection includes correspondence, meeting materials, drafts, grant material, project proposal material, and other records related to the Principles of the Law of Family Dissolution project, published in 2002. This collection spans the years 1985 to 2000.

Abstract:

The Federal Judicial Code Revision Project is the Institute's third major work on the jurisdiction of the federal courts. In 1969, the American Law Institute published its Study of the Division of Jurisdiction Between State and Federal Courts. In 1994 it finished work on the Complex Litigation Project and published Complex Litigation: Statutory Recommendations and Analysis. This work reconsiders three subjects within Title 28 of the United States Code: supplemental jurisdiction, venue, and removal.

Abstract:

In response to the proliferation of complex litigation cases and the myriad issues they raise, the American Law Institute commissioned a project which ultimately became known as Complex Litigation: Statutory Recommendations and Analysis. The report provides a timely and valuable resource for practitioners involved with the problems presented by complex litigation as it exists today, as well as for those concerned with developing a more just, fair, and efficient system for dealing with complex cases. The collection, 1986-1993, includes drafted and related materials pertaining to the creation of the American Law Institute project called Complex Litigation: Statutory Recommendations and Analysis.

Transnational Insolvency Project records, 1991-1997 (inclusive)

Abstract:

The North American Free Trade Agreement has stimulated a large increase in economic activity that crosses the Canadian, Mexican, and United States borders. Inevitably, this has resulted in an increase in the number of bankruptcies in which creditors and assets are located in more than one of the NAFTA countries. The American Law Institute's (ALI's) Transnational Insolvency: Cooperation Among the NAFTA Countries arose in response to this increasing number of bankruptcies of multinational economic enterprises. The Project's eventual goal was to develop principles and procedures for managing the general default of an economic enterprise having its center of interest in a NAFTA country and having assets, creditors, and operations in more than one NAFTA country. The collection, 1991-1997, includes drafts and related materials pertaining to the creation of international statements for United States Bankruptcy Law, Canadian Bankruptcy Law, and Mexican Bankruptcy Law.

Abstract:

The American Law Institute (ALI) was founded in 1923 in response to a perceived uncertainty and complexity in American law. Former Penn Law Dean William Draper Lewis was the Institute's first director, running the organization's operations out of his campus office. The ALI was conceived as a representative gathering of the American Bar (including Judges, Lawyers, and Law Professors) for the stated mission "to promote the clarification and simplification of the law and its better adaptation to social needs, to secure the better administration of justice and to encourage and carry on scholarly and scientific legal work." To that end, the ALI has held annual meetings since its inception to adopt its restatements and other codification projects, discuss drafts, analyze pending legislation and aspects of the law, set policy, and initialize new projects. Abstract:

Mary Kay Kane graduated from University of Michigan Law School in 1971. She served as a Professor at the State University of New York - Buffalo Law School from 1974 to 1977 and as a professor, Academic Dean, Dean, and Chancellor at the University of California, Hastings Law School from 1977 to 2006. Kane's area of interest was civil procedure from which she published many books and articles. She served as the Assistant Reporter for the American Law Institute Complex Litigation Project.The Mary Kay Kane Papers (Complex Litigation Project), 1988-1993, include correspondence and meeting transcripts related to Kane's work as Assistant Reporter on the American Law Institute (ALI) Complex Litigation Project, published in 1994 as Complex Litigation: Statutory Recommendations and Analysis. Deborah A. DeMott papers (Restatement (Third) of Agency), 1994-2007 and undated (inclusive)

Abstract:

Deborah A. DeMott completed her B.A. in 1970 from Swarthmore College and received her Juris Doctorate from New York University in 1973. DeMott spent her early years in DuBois, Pennsylvania. She served as articles editor of the New York University Law Review. DeMott began her professional career with a judicial clerkship in a federal court in New York City, and later practiced with a large law firm in that city, until she joined the Duke law faculty in 1975. In 1989, she received the Scholar/Teacher of the Year Award from Duke University. Professor DeMott served as the Reporter for the American Law Institute's Restatement (Third) of Agency, published in 2006. This collection includes materials such as correspondence, financial material, notes, printed materials, and council and preliminary drafts of the Restatement of the Law Third.

Abstract:

In 1989, the American Law Institute began producing videotaped oral history interviews with individuals who were active in the Institute's affairs. The project is ongoing. The Oral Histories Record Group, 1989-1993, includes video oral history recordings with Herbert Wechsler (1989 April 13), Homer Kripke (1989 September 9), and A. James Casner (1990 May 16). Each oral history has a corresponding transcript. Also included is a typewritten transcript of an oral history with Paul Wolkin (1993 July 8 and 26).

David L. Bazelon Papers, 1941-1993 and undated (inclusive)

Abstract:

David Lionel Bazelon (1909-1993) graduated from Northwestern University Law School in 1932. In 1936, Bazelon joined the United States Attorney's Office in Chicago, where he specialized in tax cases. In 1949, President Harry S. Truman appointed Bazelon to the newly-created United States Court of Appeals for the District Columbia, making Bazelon, at forty years old, one of the youngest people ever appointed to a federal judgeship. He served on the court from 1949 to 1984, acting as Chief Judge from 1962 to 1978. During this time the Circuit Court of Appeals for the District of Columbia was often considered the nation's second highest court. In his years on the court Bazelon was involved in decisions on matters ranging from the use of DDT to the definition of insanity. In the mid-1980s Bazelon stopped hearing cases and finally retired from the bench. He died on February 19, 1993, of Alzheimer's disease. Henry S. Drinker Papers, 1929-1950 (inclusive)

Abstract:

Henry S. Drinker (1880-1965) was graduate of Haverford College, Harvard University, and the University of Pennsylvania. In 1904, Drinker joined the Philadelphia Law firm Drinker Biddle & Reath in 1904. Drinker's book "Legal Ethics" was published in 1933. An amateur musicologist, Drinker founded the Drinker Library of Choral Music at the Free Library of Philadelphia. The Drinker Music Center was dedicated in his name at Haverford College in 1962. Primarily writings by Henry S. Drinker regarding criticism by Sir Francis Newbolt over some of his books, an essay called "Legal Plots," and a writing called "The Lawyers of Anthony Trollope. The collection, 1929-1950, also includes correspondence with Alfred A. Knopf and Sir Francis Newbolt.
