Overview and metadata sections
The Model Penal Code, first completed in 1962 and revised and expanded over the next 20 years, played a role in the revision and codification of criminal law. Work on the project began in earnest in 1952, following initial funding by the Rockefeller Foundation. The Chief Reporter on the project was Herbert Wechsler. A Criminal Law Advisory Committee was established to guide the reportorial staff in drafting the Code. The committee collected academics, practitioners, judges, and other experts in criminal law.
The original Model Penal Code project generated 13 Tentative Drafts (TD), published from 1953 to 1960. A proposed Final Draft followed in 1961, followed by the Proposed Official Draft in 1962. Judge Goodrich planned to revise the 1962 Proposed Official Draft, adding commentaries with plans of publishing an Official Draft by 1964, but the death of Judge Goodrich and Paul Tappan along with Herbert Wechsler assuming the role of Director, pushed the Model Penal Code revision and commentary project back a decade (Herbert Wechsler letter to Donald E. Santarelli, December 30, 1974, Box 1 Folder 10). The 1962 Proposed Official Draft and 13 Tentative Drafts generated wide responses among legislatures and courts, and in 1976, with a decade of adoption and rejection of the Code to draw upon, the ALI undertook the revision and expansion of the Code's commentaries along with a study of the over forty draft codes in use by 1976.
A final version of the Model Penal Code, with revised commentaries, was published in 1985. The Code impacted the areas of jurisdiction, double jeopardy, responsibility, criminal attempts, theft, abortion, obscenity, sentencing, and capital punishment.
The Model Penal Code Records, 1935-1987, include correspondence, meeting records, proceedings, drafts, reports, reference materials, publications, citations, and related records regarding the drafting of the Model Penal Code, from the project's early days of fundraising to its final publication in 1985 to the 25th anniversary conference in 1987.
Series I: Correspondence, 1946-1985, contains letters between American Law Institute reporters, ALI organizers, and funding entities that sponsored the Model Penal Code project.
Series II: Meeting Records, 1951-1962, contains materials created for meetings including correspondence, minutes, discussion drafts, and notes.
Series III: Drafting Records, 1935-1971, contains materials created throughout the drafting process including correspondence, memoranda, Tentative Drafts (TD), Preliminary Drafts (PD), and Council Drafts (CD).
Series IV: Comments, 1976-1981, contains drafting materials including correspondence, notes, and annotated drafts created for the Model Penal Code's 1985 official draft publication.
Series V: Official Draft Volumes, 1985, contains the official draft publications of parts 1 and 2 of the Model Penal Code with revised comments.
Series VI: Citations, 1980-1985, contains articles printed in various journals that cite the Model Penal Code's use in appellate cases.
Series VII: Conferences, 1986-1987, includes correspondence, planning materials, and conference papers prepared to celebrate the 25th anniversary of the Model Penal Code's completion.
