Collection of "Recent Bankruptcy Decisions" by George Treister, 1981-1990, 1992-1998 (inclusive)

Abstract:
George Treister (b. 1923) was a founding partner of Stutman, Treister, and Glatt. A graduate of Yale University Law School in 1949, Treister was a member of the Judicial Conference's Advisory Committee on Bankruptcy Rules and the National Bankruptcy Conference, where he served as Vice Chairman from 1971 to 1984. He is the author of a number of bankruptcy volumes, including "Recent Bankruptcy Decisions," a compendium of judicial decisions regarding bankruptcy legislation, used as educational material by nearly all major bankruptcy seminars. The collection comprises volumes of George Treister's "Recent Bankruptcy Decisions" from 1981 to 1990 and from 1992 to 1998.

Randall J. Newsome Oral History collection, 1993-1998, 2004 (inclusive)

Abstract:
Randall J. Newsome (b. 1950) graduated from the University of Cincinnati Law School in 1975. In 1998, Newsome was appointed to the Northern District of California's bankruptcy court, where he became Chief Judge in 2004. Randall Newsome has served as a faculty member for the Federal Judicial Center since 1987. He joined the National Conference of Bankruptcy Judges in 1983, serving as President from 1998-1999. He is a fellow of the American College of Bankruptcy. The collection (1993-2004) includes audio cassette tapes of interviews with important figures in bankruptcy law, conducted by Newsome.

Francis R. Kirkham Law Clerk papers, circa 1935-1938 (inclusive)

Abstract:
Francis Kirkham (1904-1996) was born in Utah in 1904. After earning his undergraduate and law degrees from George Washington University, Kirkham clerked for two Supreme Court Justices, including former Chief Justice Evan Hughes. During his time as a law clerk, Kirkham drafted a report suggesting revisions to the way people filed for bankruptcy, which was a pertinent issue in the wake of the Great Depression. This report, "Suggested Revisions to the General Orders and Forms of Bankruptcy," was published in 1939. The collection, circa 1935-1939, includes correspondence with Supreme Court Justices, drafts, reports, National Bankruptcy Conference drafts, and related material regarding Kirkham's activity as a Supreme Court law clerk drafting the "General Order and Rules of Bankruptcy," which was published in 1939.

In 1964, the American Law Institute (ALI) secured funding to examine and codify the law relating to land use and development. The resulting document was the Model Land Development Code, adopted by the ALI in May 1975. The collection, 1960-1974 and undated, includes preliminary studies, drafts, memoranda, correspondence, and related material concerning the drafting and adoption of the Model Land Development Code.

Abstract:
In March 1925, the American Law Institute (ALI) started the Code of Criminal Procedure project. The resulting volume attempted to provide a framework for effective administration of criminal law while maintaining protection for the rights of the accused. The collection, circa 1925-1959, includes drafts, correspondence, minutes, and other materials related to the drafting of the code, which outlined procedures for carrying out criminal law and defined the rights of the accused in areas such as arrest, bail, and execution.

Recognition and Enforcement of Foreign Judgments Project records, 2002 september 30 (inclusive)

This project culminated in "Recognition and Enforcement of Foreign Judgments: Analysis and Proposed Federal Statute," which would impose uniform standards for recognition and enforcement of foreign judgments throughout the United States. It also includes a comprehensive review of current law and discussion of the constitutional basis for federal legislation on the subject of foreign judgments. The project was formerly known as the International Jurisdiction and Judgments Project. This collection consists of one item: Council Draft No. 2, 2002 September 30.

David L. Bazelon Papers, 1941-1993 and undated (inclusive)

Abstract:
David Lionel Bazelon (1909-1993) graduated from Northwestern University Law School in 1932. In 1936, Bazelon joined the United States Attorney's Office in Chicago, where he specialized in tax cases. In 1949, President Harry S. Truman appointed Bazelon to the newly-created United States Court of Appeals for the District Columbia, making Bazelon, at forty years old, one of the youngest people ever appointed to a federal judgeship. He served on the court from 1949 to 1984, acting as Chief Judge from 1962 to 1978. During this time the Circuit Court of Appeals for the District of Columbia was often considered the nation's second highest court. In his years on the court Bazelon was involved in decisions on matters ranging from the use of DDT to the definition of insanity. In the mid-1980s Bazelon stopped hearing cases and finally retired from the bench. He died on February 19, 1993, of Alzheimer's disease. John Dickinson Notebooks, 1940s (inclusive)

Abstract:
John Dickinson was born in Greensboro, Maryland in 1894. He was a descendent of John Dickinson, who drafted the Articles of Confederation. After teaching American and Medieval history, Dickinson earned his Ph.D. from Princeton University in 1919. That same year, he enrolled at Harvard Law School, where he received his LL.B. degree in 1921. At the time, Dickinson practiced law in New York and Los Angeles. He also was a noted writer, publishing his Administrative Law and the Supremacy of Nations in 1927. A pioneering work in administrative law, the book is widely regarded as a legal classic. After stints teaching at Harvard and Princeton, Dickinson accepted an offer to teach at the University of Pennsylvania Law School in 1929, where he remained until his resignation in 1948. Peter McCall was born in Trenton, New Jersey in 1809. McCall was Professor of practice, pleading, and evidence at law and in equity at Penn Law School. After resigning his post at the Law School, he became a University Trustee. McCall was a prominent member of Philadelphia public life, serving as mayor in 1844 and as Chancellor of the Law Academy of Philadelphia, the oldest law association in the United States, from 1873 until his death in 1880.

Owen J. Roberts Outlines for Constitutional Law Lectures, undated (inclusive)

Abstract:
Owen J. Roberts was born in Philadelphia in 1875. He graduated from the University of Pennsylvania with a bachelor's degree in 1895 and a law degree in 1898. While at Penn, Roberts edited "The Daily Pennsylvanian." He later served as Professor at the Law School from 1898 to 1918. Roberts was an Associate Justice of the United States Supreme Court from 1930 to 1945. After stepping down from the bench, he served as Dean for the University of Pennsylvania Law School from 1948 to 1951. Roberts died in 1955. The collection includes outlines of lectures Owen J. Roberts gave at the University of Pennsylvania Law School on Constitutional Law.

John Honnold United Nations Correspondence, circa 1983-1993 (inclusive)

Abstract:
John Honnold (1915-2011) graduated from Harvard University Law School in 1936 and became Chief of the Court Review Branch of the Office of Price Administration during World War II. Honnold served as a Professor at the University of Pennsylvania Law School from 1946 to 1969, when he became Chief of Legal Staff to the Commission on International Trade Law (UNCITRAL). He resumed teaching at the Penn Law School in 1974 while working on the UNCITRAL draft that was ratified at the Vienna Convention. The collection, circa 1983-1993, includes copies of letters Honnold sent and received as the co-chairman of the U.S. Delegation to the Vienna Conference and Chief of Staff of UNCITRAL. The collection also contains a reference file that spans from 1986 to 1993.

James Wilson Documents, 1779-1796 (inclusive)

Abstract:
Born on September 14, 1742 in Carskerdo, Fife, Scotland. Although James Wilson attended numerous universities while living Scotland, he never attained a degree. It was Wilson's pursuit of studying law that helped pave become a significant figure in American history. Wilson began studying law at the law office of John Dickinson. By 1766, Wilson attained the bar in Philadelphia and soon after opened his own practice in Reading. Wilson was fairly successful as a lawyer and he managed to amass a small fortune during this time. Wilson's greatest achievement in public life was his part in the establishment of the United States Constitution. He regularly advocated the idea that sovereignty resided in the people, that the President and members of both houses of Congress should be popularly elected. William Draper Lewis Personal Correspondence, 1874-1949 (inclusive)

Abstract:
William Draper Lewis was born in Philadelphia in 1867. In 1891, he received both a law degree and a Ph.D. in economics from the University of Pennsylvania. In 1892, he became editor of the American Law Register, one of the oldest legal periodicals of the time. That same year, Lewis married Caroline Mary Cope. They had four children, Henry, Alfreda Cope, Anna, and William Draper Jr. and resided in Germantown, Pennsylvania. In 1896, Lewis joined the law department at the University of Pennsylvania as Dean and Professor of Law. Under Lewis' leadership, the law school flourished as he recruited new faculty, broadened the curriculum, and strengthened the collections of the Biddle Law Library. He served as Dean until 1914 but continued on the faculty until 1924. In 1923, Lewis became the founding director of the American Law Institute (ALI). Lewis died in Northeast Harbor, Maine in 1949. George Wharton Pepper was born in Philadelphia in 1867. He graduated from Penn Law School with an LL.B. in 1889 and was first in his class. As a student, Pepper helped found The Daily Pennsylvanian, the university's student-run examination. In addition to studying law with Philadelphia scion George Washington Biddle, Pepper taught at Penn Law School from 1893 to 1910, when he left to attend to his expanding private practice. Pepper also served as United States Senator for Pennsylvania from 1922 to 1927. The collection, 1886-1954, include correspondence regarding law school matters; syllabi, notes, lectures, and case files, probably from the 1890s; papers related to Pepper's service on the Trustee Committee and Reorganization Committee; and articles and other writings drafted by Pepper.

Bernard G. Segal papers, 1910-1997 (inclusive)

Abstract:
Bernard G. Segal graduated from the University of Pennsylvania Law School (now known as the University of Pennsylvania Carey Law School) in 1931. Segal became the youngest Deputy Attorney General in Pennsylvania's history in 1932, the first Jewish lawyer elected Chancellor of the Philadelphia Bar Association in 1952, and the first Jewish president of the American Bar Association in 1969. Segal also co-chaired the Lawyers Committee for Civil Rights Under Law and headed the Office of Economic Opportunity's Advisory Committee on Legal Services to the Poor. The Bernard G. Segal papers document all of Segal's activities outside of his work as a lawyer at Schnader, Harrison, Segal, and Lewis. This includes correspondence, reports, and minutes from his professional associations, governmental appointments, and his civic work.

Abstract:
The state bar examination is a test that law school graduates are required to pass in order to practice law in a specific jurisdiction. The bar exam is usually conducted two or three times a year, depending on the state. As a recent standard rule, the bar exam is always held on the last Tuesday and Wednesday of every February and July of a calendar year. Historically, this was not always the case. The State Bar Exam Records contains materials that reveal how the early twentieth century bar examinations in New Jersey, New York, and Pennsylvania did not limit the test to be administered in February and July. Instead, New Jersey administered the bar examination three times a year: February, June, and November; Pennsylvania administered the bar examination two times a year: July and December; and New York administered the bar examination three times a year: January, June, and October.

This collection features a series of materials partially documenting the career of lawyer and legal scholar William E. Mikell. Most notably featured in this collection are various drafts of the criminal codes Mikell was heavily involved in planning and drafting during his career. Speeches given by and about Mikell are included in their original forms, as well as person memorabilia including Mikell's 1890 Master's degree from The Citadel. The American Law Institute (ALI) was founded in 1923 in response to a perceived uncertainty and complexity in American law. An association of practitioners and scholars known as the "Committee on the Establishment of a Permanent Organization for Improvement of Law" published a study that recommended a lawyers' organization be formed to improve the law and its administration. The committee was chaired by Elihu Root and counted Learned Hand, Benjamin Cardozo, and Samuel Williston among its members. This photograph collection is comprised of portraits of ALI directors, presidents, members, and staff. In the midst of World War II, the American Law Institute convened a committee in 1941 to study the international community's position regarding human rights law. The committee's charge was to develop a Statement of Essential Human Rights. William Draper Lewis, then Director of the American Law Institute, was chair of the committee and the project's most outspoken advocate, touring the world to deliver speeches on the importance of a code of basic human rights. International in scope and in participation, the committee included representatives from Britain, Canada, China, France, pre-Nazi Germany, Italy, India, Latin America, Poland, Soviet Russia, Spain, and Syria. Following the publication of the First Restatement of the Law, in 1936 the American Law Institute (ALI) held a series of meetings and published a series of reports that considered what additional areas of the law might be selected for future restatement projects. Work on the project continued into the mid-1940s. Many fields were considered, but only a few were actually selected for inclusion in future restatement projects. The collection, 1929-1968 and undated (bulk: 1929-1948), includes correspondence, reports, memoranda, and other records related to areas of the law up for consideration for future restatement projects, including business associations, industrial relations, and monopolies.

Henry S. Drinker Papers, 1929-1950 (inclusive)

Abstract:
Henry S. Drinker (1880-1965) was graduate of Haverford College, Harvard University, and the University of Pennsylvania. In 1904, Drinker joined the prominent Philadelphia Law firm Drinker Biddle & Reath in 1904. An authority on legal ethics, Drinker's book on the subject, "Legal Ethics," was published in 1933 and went on to become a classic. An amateur musicologist, Drinker founded the Drinker Library of Choral Music at the Free Library of Philadelphia. The Drinker Music Center was dedicated in his name at Haverford College in 1962. George W. Taylor (1901-1972) was born in Philadelphia, Pennsylvania. He attended the University of Pennsylvania's Wharton School, graduated with a Bachelor's Degree in Economics in 1921 and a Ph.D. in 1929.Taylor taught at Wharton for over 30 years of which during that time, he became an influential expert in the field of industrial relations, including arbitration, mediation, and alternative dispute resolution. Taylor received major acclaim when he mediated an end to the Apex Hosiery Strike in Philadelphia in 1932 and orchestrated the passage in 1967, of the Public Employees Fair Employment Law, which is commonly known as "the Taylor Law." The collection, 1921-1970, consists of correspondence, trade negotiations, laws, agreements and studies surrounding the hosiery labor industry in the early to mid 20th century. The Uniform Commercial Code (UCC) was the result of a joint project between the American Law Institute (ALI) and the National Conference of Commissioners on Uniform State Law (NCCUSL). Work on the UCC began in 1945 in response to a perceived need by members of both ALI and NCCUSL to consolidate a number of uniform laws, previously enacted by NCCUSL, related to commercial transactions. NCCUSL was established in 1891 for the purpose of codifying state law by creating uniform laws and model acts. ALI was founded in 1923 in response to a perceived uncertainty and complexity in American Law. The Institute had previously developed a codification of particular areas of the law, known as the Restatement of the Law. In 1938, the American Law Institute (ALI) formed the Criminal Justice--Youth Committee to review the findings of a New York City study of criminal behavior among young people called "Youth in the Toils." The culmination of the committee's work was the Model Youth Correction Authority Act, a model act that favored the integration of a number of youth treatment processes already employed by various states. The committee also proposed the creation of a Youth Authority, a state-wide panel that would handle sentencing guidelines, with an emphasis on treatment and not punishment, for all underage criminal offenders. Following the Model Youth Corrections Authority Act's promulgation in 1940, the ALI appointed a special adviser, John R. Ellingston, to help states adopt Youth Authority legislation. In the course of establishing what would become the First Restatement of the Law, the American Law Institute (ALI) considered including a clarification of the Law of Evidence. However, due to perceived deficiencies in the law, the American Law Institute resolved to begin a project that would provide a thorough reworking of the existing law of evidence. In 1939, the ALI secured funding to develop such a project. Edmund M. Morgan served as Reporter, and John H. Wigmore served as Chief Consultant. The resulting body of law was the Model Code of Evidence, adopted by the ALI in May 1942. A Proposed Official Draft was published in 1962. This version generated wide response among legislatures and courts, prompting a revision and expansion of the code's commentaries that began in 1976. Known as the Income Tax Project, the primary objective was not to codify the law but to provide analysis of issues as they related to the United States' increasingly complex tax code. Cooper received his A.B. from Princeton University in 1909 and was admitted to the Florida Bar in 1911. Cooper married Martha Helen Marvel in 1918 and the couple had three children. He served in the U.S. Navy from 1917-1921 and held the rank of lieutenant and eventually Lieutenant-Commander. After being relieved from active service with the U.S. Navy, Cooper embarked on a career that eventually led him to become an influential figure on international air and space law. The Judge Dolores Sloviter papers, 1965-2012, consists of material documenting Sloviter's active involvement in the legal profession. Dolores Korman Sloviter graduated with her LL.B. from the University of Pennsylvania Law School (now known as University of Pennsylvania Carey Law School) in 1956 where she was one of eight women in her graduating class. She was appointed to the United States Court of Appeals for the Third Circuit in 1979 and served as Chief Judge from 1991 to 1998. The collection contains correspondence, reports, and news clippings that document Sloviter's time serving on the Third Circuit and her involvement in professional legal organizations. The collection also includes speeches that Sloviter gave at seminars/colloquia where she often spoke on the history and current role of women in the legal profession.

Henry J. Sommer is one of the leading figures in bankruptcy and consumer law. Born in 1949 in Rochester, New York, Sommer received his JD cum laude from Harvard Law School in 1974. After graduating from Harvard, he worked for Community Legal Services in Philadelphia as Project Head of its Consumer Law Project until 1996. In addition to his role with Community Legal Services, Sommer has served on bankruptcy rules committees and worked as editor-in-chief of Collier on Bankruptcy. The Henry J. Sommer Papers, 1966-2014, include National Bankruptcy Conference papers, materials from Continuing Legal Education seminars and other meetings at which Sommer lectured, copies of published manuscripts written by Sommer, and other material related to Sommer's work with consumer law and legal reform.

Ralph H. Kelley (1928-2004) was appointed United States Bankruptcy Judge in the Sixth Federal Judicial Circuit in 1969. In 1993 he retired as Chief Judge of the Bankruptcy Court for the Eastern District of Tennessee but remained the court's senior judge. He was a member of the National Conference of Bankruptcy Clerks and the National Conference of Bankruptcy Judges, where he served as President from 1985 to 1986. In 1980, Ralph Kelley was appointed to the Committee on the Budget of the Judicial Conference of the United States, where he served until 1990. Judge Arthur N. Votolato was the first bankruptcy judge to sit in Rhode Island, and for 44 years, he was the only U.S. bankruptcy judge to serve the state. He served on the First Circuit Bankruptcy Appellate Panel, Massachusetts and Maine panels. He was Chief Judge, Massachusetts' B.A.P. from 1981 to 1984. The Judge Arthur N. Votolato papers is a small collection of material relating to Votolato's work in bankruptcy law. In the late 1960s, the American Bar Association's Committee on Federal Regulation of Securities recommended that a codification of securities law be undertaken by the American Law Institute (ALI). The ALI approved the project, appointing Louis Loss as the reporter in 1969. The purpose of the project was to analyze, integrate, and improve an array of federal acts related to securities law. The American Bar Association played an active role in reviewing and advising the committee on its work. The ALI approved the Federal Securities Code on May 19, 1978. Loss continued working with the project's consultants, advisers, and other interested parties to prepare a final draft of commentary on the code. Although the ALI assumed no responsibility for Loss's comments, the organization authorized the publication of a Reporter's Commentary with the Federal Securities Code in 1980. Kenneth N. Klee spent his career analyzing bankruptcy law and advocating for pro-debtor reforms to the Bankruptcy Code. He graduated from Harvard Law School in 1974 and joined to the California bar in 1975. He began his career as Associate Counsel for the Subcommittee on Civil and Constitutional Rights, a subunit of the House of Representatives' Committee on the Judiciary, where he advised Congress and helped draft legislation related to bankruptcy reform in the 1970s. He was also a consultant to the House Judiciary Committee from 1977 to 1982 and the Department of Justice from 1983 to 1985. The Ira Ellman Family Dissolution Papers house the correspondence and printed material of the Chief Reporter of the American Law Institute on the ten year study of the Principles of the Law of Family Dissolution. The collection chronicles Ellman's term as Chief Reporter on the Project starting in 1991 and ranging until the study's completion in 2001. A majority of the collection is composed of printed material of various sources and Principle drafts, as well as some correspondence between Ellman and a variety of law professors concerning the process of creating tentative drafts on the issue of family dissolution. Edward Weinfeld (1901-1988) graduated from the New York University School of Law in 1921. In 1950, he was appointed to the Federal bench for the Southern District of New York, a position he held for the rest of his career. In addition to his career as author, professor, and judge, Weinfeld served on the Commission on Bankruptcy Laws of the United States in the 1970s, an organization appointed by Congress in 1970 to conduct a sweeping study of current bankruptcy law. Joseph L. Cosetti was appointed United States Bankruptcy Judge for the Western District of Pennsylvania in 1980, where he served as Chief Judge until 1994. Robert B. Morton (1912-2005) earned his law degree from the University of Kansas in 1935. In 1962, Morton became a judge in the United States Bankruptcy Court, a position he held until 1986. Upon his retirement from the court, Morton worked for Morris, Laing, Evans, Brock and Kennedy, a law firm located in Wichita, Kan. Morton was an active member in a number of bankruptcy and legal organizations, most notably the National Conference of Bankruptcy Judges, where he served as President from 1975 to 1976 and as Treasurer from 1980 to 1982. The American Law Institute (ALI) was founded in 1923 in response to a perceived uncertainty and complexity in American law. Former Penn Law Dean William Draper Lewis was the Institute's first director, running the organization's operations out of his campus office. The ALI was conceived as a representative gathering of the American Bar (including Judges, Lawyers, and Law Professors) for the stated mission "to promote the clarification and simplification of the law and its better adaptation to social needs, to secure the better administration of justice and to encourage and carry on scholarly and scientific legal work." The Third Restatement of the Law covered subjects including Foreign Relations Law and the Law Governing Lawyers. William J. Weller joined the Administrative Office of the United States Courts as Legislative Affairs Officer in 1976. In 1984 he was at the center of a lawsuit regarding his firing of United States Bankruptcy Judges over a dispute regarding their contract and status of employment. The lawsuit and pending legislation related to a broader dispute over the status of presidentially-appointed bankruptcy judges. Weller left the Administration Office in 1987.
