Abstract:
As a teacher, scholar, lawyer, and consultant, Lawrence P. King (1929-2001) played an important role in the reform of bankruptcy law from the 1960s to his death in 2001. King taught commercial and bankruptcy law at New York University Law School. He served on a number of congressional commissions formed to analyze and reform bankruptcy law, including the Advisory Committee on Bankruptcy Rules of the Judicial Conference of the United States. He gave speeches and participated in panels regarding bankruptcy legislation for a number of seminars and educational programs. He was an active member of the National Bankruptcy Conference, an organization of lawyers, judges, and professors dedicated to bankruptcy reform. He had leadership roles in National Bankruptcy Conference committees, including the Committee on Legislation, where he was Chairman. Ralph H. Kelley (1928-2004) was appointed United States Bankruptcy Judge in the Sixth Federal Judicial Circuit in 1969. In 1993 he retired as Chief Judge of the Bankruptcy Court for the Eastern District of Tennessee but remained the court's senior judge. He was a member of the National Conference of Bankruptcy Clerks and the National Conference of Bankruptcy Judges, where he served as President from 1985 to 1986. In 1980, Ralph Kelley was appointed to the Committee on the Budget of the Judicial Conference of the United States, where he served until 1990. Abstract:
Murray Drabkin (1928-) was a commercial bankruptcy lawyer at Hopkins and Sutter in Washington, D.C. until 2001. He was a member of the National Bankruptcy Conference and co-authored the "Judges' bill," which, together with the "Commission bill," drafted by a federal commission to study bankruptcy laws, was the basis for the Bankruptcy Reform Act of 1978. The collection, 1932-1999, includes materials relating to bankruptcy reform and the jurisdiction of bankruptcy judges in the 1970s and 1980s; records and papers of the National Bankruptcy Conference, where Drabkin was an active member; material relating to two important legislative projects formed by the National Bankruptcy Conference, the Code Review Project and the Insurance Insolvency Project; correspondence related to the activities of bankruptcy committees in New York and Washington, D.C.; and published manuals, reports, and reference books.

Abstract:
The National Bankruptcy Conference is a voluntary, non-profit, self-supporting organization of lawyers, law teachers, and bankruptcy judges who have achieved scholarly distinction in the field of bankruptcy law. Its purpose is to study the operation of bankruptcy and related laws and proposals for their reform. The Conference participated as a consultant to Congress in every substantial amendment of the Bankruptcy Act up to the 1970s. The collection includes minutes summaries of proceedings of National Bankruptcy Conference meetings from 1948 to 1996 and reports submitted by the Committee on Coordination of Uniform Commercial Code and Bankruptcy Act.

Kenneth N. Klee spent his career analyzing bankruptcy law and advocating for pro-debtor reforms to the Bankruptcy Code. He graduated from Harvard Law School in 1974 and joined to the California bar in 1975. He began his career as Associate Counsel for the Subcommittee on Civil and Constitutional Rights, a subunit of the House of Representatives' Committee on the Judiciary, where he advised Congress and helped draft legislation related to bankruptcy reform in the 1970s. He was also a consultant to the House Judiciary Committee from 1977 to 1982 and the Department of Justice from 1983 to 1985. Klee was a member of the National Bankruptcy Conference, an association of scholars and practitioners committed to the study of bankruptcy legislation and reform, where he was chair of the Committee on Legislation from 1992 to 1999. Merrill R. Francis (born 1932) joined the firm of Sheppard, Mullin, Richter, and Hampton in 1959. He specialized in commercial law, bankruptcy, and secured and unsecured creditor representation. George Treister (b. 1923) was a founding partner of Stutman, Treister, and Glatt. A graduate of Yale University Law School in 1949, Treister was a member of the Judicial Conference's Advisory Committee on Bankruptcy Rules and the National Bankruptcy Conference, where he served as Vice Chairman from 1971 to 1984. He is the author of a number of bankruptcy volumes, including "Recent Bankruptcy Decisions," a compendium of judicial decisions regarding bankruptcy legislation, used as educational material by nearly all major bankruptcy seminars. Randall Newsome has served as a faculty member for the Federal Judicial Center since 1987. He joined the National Conference of Bankruptcy Judges in 1983, serving as President from 1998-1999. National Conference of Bankruptcy Judges Oral History Project, 2004-2008 (inclusive)

The Oral History Project was begun by the National Conference of Bankruptcy Judges (NCBJ) at its 2004 Annual Meeting. The purpose of the project was to record interviews in which past presidents of the NCBJ reminisced about the organization and the role they played in it. The project later expanded to encompass oral histories of prominent bankruptcy judges. The collection chiefly includes oral histories recorded with past presidents of the National Conference of Bankruptcy Judges. Accruals to this project include prominent members of the NCBJ who may or may not be former presidents.

Frank W. Koger, 1930-2003, received his J.D. from Kansas City University in 1953 and his L.L.M. from University of Missouri in 1966. After having worked in private practice since 1956, Koger was appointed Bankruptcy Judge to the Eighth Judicial Circuit in 1986. He remained in this position until his retirement in 1997. Koger was a member of the American Bar Association, the Commercial Law League of America, and the Missouri Bar Association. He was also a member of the National Conference of Bankruptcy Judges, where he served as Secretary, Vice President, and President in the 1990s. The collection, 1990-1997, chiefly includes records created and assembled by Koger as a member of the National Conference of Bankruptcy Judges from 1993-1997. Conrad B. Duberstein collection, 2005 (inclusive)

Abstract:
Conrad B. Duberstein (1915-2005) earned his undergraduate degree from Brooklyn College in 1938 and his J.D. from St. John's University Law School in 1942. From 1943 to 1945, Duberstein served in the United States Army, where he was awarded the Purple Heart, the Bronze Star, and the Combat Infantry Badge. When he left the Army following the end of World War II, Duberstein joined the Brooklyn law firm of Schwartz, Rudin, and Duberstein (the latter partner named after his uncle). In 1971, he became a partner at Otterbourg, Steindler, Houston, and Rosen, where he remained until his retirement in 1981. In 1981, he was appointed to the Eastern District Bankruptcy Court of New York. He was appointed that court's Chief Judge in 1984, a position he held for the rest of his career. In 1991, he was awarded an honorary doctorate from St. John's University Law School. The collection, 2005, contains 5 DVDs of footage honoring the career of Duberstein.

Kronish, Lieb, Weiner, and Hellman LLP Bankruptcy Judges Lawsuit files, 1984-1994 (inclusive)

On July 11, 1984, William Foley, Legislative Affairs Officer of the Administrative Office of the United States Courts ("Administrative Office"), issued a memorandum stating that the Administrative Office would not pay bankruptcy judges because, in its opinion, Congress had acted unlawfully by awarding retroactive terms of office to the normally presidentially-appointed bankruptcy judges. In response, on July 13, 1984, four bankruptcy judges sued Foley and the Administrative Office for abuse of power. The case became commonly known as Lundin v. Foley. George C. Paine II was born on October 31, 1945 in Nashville, Tenn. He graduated from the University of Mississippi School of Law in 1973. In 1981, Paine was appointed a bankruptcy judge for the Middle District of Tennessee. He has served as Chief Bankruptcy Judge of that district since 1986. In 1984, George Paine was one of four judges who filed suit against the Administrative Office of the United States Courts ("Administrative Office"). The Administrative Office's director, William Foley, had refused to pay bankruptcy judges, arguing that parts of the Bankruptcy Amendments and Federal Judge Act of 1984 were unconstitutional. The case was later rendered moot when Foley rescinded his order and agreed to pay the judges. Abstract:
Francis Kirkham (1904-1996) was born in Utah in 1904. After earning his undergraduate and law degrees from George Washington University, Kirkham clerked for two Supreme Court Justices, including former Chief Justice Evan Hughes. During his time as a law clerk, Kirkham drafted a report suggesting revisions to the way people filed for bankruptcy, which was a pertinent issue in the wake of the Great Depression. This report, "Suggested Revisions to the General Orders and Forms of Bankruptcy," was published in 1939. The collection, circa 1935-1939, includes correspondence with Supreme Court Justices, drafts, reports, National Bankruptcy Conference drafts, and related material regarding Kirkham's activity as a Supreme Court law clerk drafting the "General Order and Rules of Bankruptcy," which was published in 1939.

In February 1982, Dixon incorporated under Nebraska law this new organization which was to be called the American Bankruptcy Institute (ABI). Mark B. McFeeley has well over thirty-five years of experience practicing law in America, of which twenty-eight years (1981-2009) was dedicated to serving as a bankruptcy judge for the U.S. Bankruptcy Court for the District of New Mexico. Judge McFeeley was instrumental in forming the Bankruptcy Appellate Panel for the Tenth Circuit. As a bankruptcy judge, McFeeley was intimately involved with the Bankruptcy Crisis of the 1980s that called into question the constitutionality of the bankruptcy system and the appointment of bankruptcy judges after the Marathon Pipeline decision in June of 1982. The William Warren papers (Federal Tax Projects) consists of Warren's papers related to the Federal Income, Estate, and Gift Tax project and Federal Income Tax Statute. In the mid-1940s, the American Law Institute (ALI) set about to analyze the law as it related to income tax. Known as the Income Tax Project, the primary objective was not to codify the law but to provide analysis of issues as they related to the United States' increasingly complex tax code. The Federal Income, Estate, and Gift Tax Project (as it would eventually be known) consisted of a series of non-binding recommendations to students, teachers, litigators, and legislators as they dealt with the evolving tax code. The Uniform Commercial Code (UCC) was the result of a joint project between the American Law Institute (ALI) and the National Conference of Commissioners on Uniform State Law (NCCUSL). Work on the UCC began in 1945 in response to a perceived need by members of both ALI and NCCUSL to consolidate a number of uniform laws, previously enacted by NCCUSL, related to commercial transactions. NCCUSL was established in 1891 for the purpose of codifying state law by creating uniform laws and model acts. ALI was founded in 1923 in response to a perceived uncertainty and complexity in American Law. The Institute had previously developed a codification of particular areas of the law, known as the Restatement of the Law. The Model Penal Code, first completed in 1962 and revised and expanded over the next 20 years, played an important role in the revision and codification of criminal law. The Chief Reporter on the project was Herbert Wechsler. A Criminal Law Advisory Committee was established to provide the reportorial staff with guidance in the drafting of the Code. A Proposed Official Draft was published in 1962. This version generated wide response among legislatures and courts, prompting a revision and expansion of the code's commentaries that began in 1976. A final version of the Model Penal Code, with revised commentaries, was published in 1985. In the midst of World War II, the American Law Institute convened a committee in 1941 to study the international community's position regarding human rights law. The committee's charge was to develop a Statement of Essential Human Rights. William Draper Lewis, then Director of the American Law Institute, was chair of the committee and the project's most outspoken advocate, touring the world to deliver speeches on the importance of a code of basic human rights. International in scope and in participation, the committee included representatives from Britain, Canada, China, France, pre-Nazi Germany, Italy, India, Latin America, Poland, Soviet Russia, Spain, and Syria. At the May 1959 Annual Meeting of the American Law Institute (ALI), Supreme Court Chief Justice Earl Warren encouraged the ALI to undertake a study to define the jurisdictions of state and federal courts. Following a feasibility study by Professor Charles Bunn, the ALI assembled a group of its members to create the Study of the Division of Jurisdiction Between State and Federal Courts, promulgated in 1968. The resulting study formed the basis of Title 28 in the United States Code. In the course of establishing what would become the First Restatement of the Law, the American Law Institute (ALI) considered including a clarification of the Law of Evidence. However, due to perceived deficiencies in the law, the American Law Institute resolved to begin a project that would provide a thorough reworking of the existing law of evidence. In 1939, the ALI secured funding to develop such a project. Edmund M. Morgan served as Reporter, and John H. Wigmore served as Chief Consultant. The resulting body of law was the Model Code of Evidence, adopted by the ALI in May 1942. In the late 1960s, the American Bar Association's Committee on Federal Regulation of Securities recommended that a codification of securities law be undertaken by the American Law Institute (ALI). The ALI approved the project, appointing Louis Loss as the reporter in 1969. The purpose of the project was to analyze, integrate, and improve an array of federal acts related to securities law. The American Bar Association played an active role in reviewing and advising the committee on its work. The ALI approved the Federal Securities Code on May 19, 1978. Loss continued working with the project's consultants, advisers, and other interested parties to prepare a final draft of commentary on the code. In 1938, the American Law Institute (ALI) formed the Criminal Justice--Youth Committee to review the findings of a New York City study of criminal behavior among young people called "Youth in the Toils." The culmination of the committee's work was the Model Youth Correction Authority Act, a model act that favored the integration of a number of youth treatment processes already employed by various states. The committee also proposed the creation of a Youth Authority, a state-wide panel that would handle sentencing guidelines, with an emphasis on treatment and not punishment, for all underage criminal offenders. Following the Model Youth Corrections Authority Act's promulgation in 1940, the ALI appointed a special adviser, John R. Ellingston, to help states adopt Youth Authority legislation.
